Is Delaware a tort or no-fault liability insurance state?

Delaware is a tort state, meaning that it holds the driver who is responsible for causing the accident liable accident-related expenses of the other driver. This may include expenses like loss of wages and pain and suffering compensation. This is different than a no-fault system, which does not require that a person be held responsible for causing an accident and will reimburse a policyholder without proof of fault.
